ROXFIT Refund Policy

This Refund Policy (the "Policy") is between you and ROXFIT LIMITED, a company registered in England and Wales under company number 15426068, whose registered office is at 128 City Road, London, United Kingdom, EC1V 2NX ("ROXFIT", "we", "us" and "our"), and sets out the framework, requirements, and eligibility criteria governing cancellations, refunds, and billing adjustments for all premium subscriptions, including ROXFIT Ultra (the "Services").

This Policy is incorporated by reference into the ROXFIT Terms and Conditions. By purchasing a subscription, you acknowledge and agree to be bound by it. Billing and refund enquiries: [email protected].

Your legal rights. Nothing in this Policy affects your statutory rights as a consumer under Applicable Law. If anything in this Policy is inconsistent with those rights, your statutory rights prevail.

1. Definitions and Interpretation

For the purposes of this Policy, the following capitalized terms shall have the meanings ascribed to them below:

"Applicable Law" means all laws, statutes, regulations, directives, and legal requirements applicable to the provision of digital services in the User's jurisdiction, including but not limited to the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the EU Consumer Rights Directive (2011/83/EU).

"Billing Cycle" means the recurring temporal period (e.g., monthly, annually) for which a User is charged for continuing access to the Services.

"Chargeback" means a demand by a credit-card provider for a retailer to make good the loss on a fraudulent or disputed transaction.

"Force Majeure Event" means any event beyond the reasonable control of ROXFIT, including but not limited to acts of God, systemic internet or telecommunications outages, cyber-attacks, natural disasters, or governmental sanctions.

"Merchant of Record" means the legal entity authorized, and held financially liable by an acquiring bank, to process consumer credit and debit card transactions. For ROXFIT web purchases, this is Sold through Link, LLC, a Stripe affiliate, operating as part of Stripe Managed Payments (see section 3).

"Seller of Record" means the entity that assumes legal ownership of the digital product prior to selling it to the end consumer (e.g., Apple, Google), bearing the statutory liability for refunds.

2. Scope and Applicability

This Policy applies to all direct-to-consumer (B2C) transactions involving the Services. The rights and obligations contained herein are personal to the account holder and are strictly non-assignable and non-transferable.

3. Purchase Channels, Privity of Contract, and Merchants of Record

The legal obligations governing your purchase, as well as the administrative procedure for requesting a refund, are strictly determined by the platform through which you executed the transaction. ROXFIT operates across multiple distinct billing infrastructures:

For subscriptions initiated directly through the ROXFIT website, the merchant of record is Sold through Link, LLC, a Stripe affiliate, operating as part of Stripe Managed Payments. Sold through Link, LLC processes your payment, issues your receipt, collects and remits any applicable taxes, and handles payment disputes. You can ask us for a refund, and you can also contact Stripe's customer support, as explained in section 5. The customer-facing brand on your financial statements may appear as Link or Onelink. For information on how Stripe handles refunds for these purchases, please see the Onelink refund help page. Stripe's payment processing services in the UK and EEA are provided by Stripe Payments Europe, Limited and Stripe Payments UK Ltd.

For subscriptions initiated within the mobile application, Apple or Google acts as the exclusive seller of record under their proprietary developer and consumer agreements. There is no direct privity of contract between you and ROXFIT regarding the financial transaction. Consequently, ROXFIT has no legal authority, technical capability, or administrative access to grant, refuse, expedite, or process refunds for store-billed subscriptions. Refunds for these purchases are decided and processed by Apple or Google under their own policies, not by ROXFIT.

4. Your Right to Cancel

Web purchases. If you live in the United Kingdom or the European Economic Area (EEA) and you subscribe to ROXFIT Ultra directly through our website, you have 14 days after signing up (the "Cancellation Period") to change your mind and cancel. You do not need to give a reason. If you cancel in time, we will refund what you paid. To cancel, follow the steps in section 5.

Free trials. If you have signed up for a free trial, you can cancel at any time before the trial ends and you will not be charged. Free trials are currently available only on the annual plan and only through the App Store and Google Play. The length of any trial is shown when you subscribe and on the store listing. Because trials are billed by the App Store or Google Play, cancel at least 24 hours before the trial ends to be certain you are not charged.

If you use ROXFIT Ultra. Please note that if you use ROXFIT Ultra during the Cancellation Period or a free trial, you lose your right of withdrawal (your legal right to cancel and be refunded). By using a ROXFIT Ultra feature, you are asking us to start providing ROXFIT Ultra straight away, and you acknowledge that you will lose that right. This does not stop you cancelling a free trial before it ends without being charged, and it does not affect your other legal rights.

Faulty or not as described. UK and EEA consumer law also says that digital content must be of satisfactory quality, fit for purpose and as described. If ROXFIT Ultra is faulty or not as described, please email [email protected] and tell us what went wrong. You may be entitled to have it put right, to a price reduction or to a refund.

App Store and Google Play purchases. If you subscribed through the App Store or Google Play, Apple or Google is the seller and its rules apply to cancelling and refunds. See section 5.

5. How to Ask for a Refund

Web purchases. To ask for a refund, or to cancel within the Cancellation Period, email [email protected] from the email address you used at checkout. Please include your order reference if you have it. You will find it on your receipt or confirmation email. If we cannot match your request to a purchase, we may ask you for the date and amount of the charge. You do not need to use any special wording.

What happens next. We will review your request and reply within 5 business days. If we approve it, we will issue the refund to your original payment method through Stripe. If you are cancelling within the Cancellation Period, we will issue your refund without undue delay and no later than 14 days after the day you tell us you want to cancel.

Contacting Stripe's customer support. You can also contact Stripe's customer support for web purchases (Onelink), using the details on your receipt or through the Onelink refund help page. It may contact us about your request, and it may issue a refund itself under its own policies. You do not have to contact both of us, but you are welcome to.

When the money arrives. Refunds usually appear on your statement within 5 to 10 business days, depending on your card issuer. If yours has not appeared after 10 business days, please email us at [email protected] or contact Stripe's customer support.

App Store and Google Play purchases. Apple or Google decides and processes refunds for these purchases under its own policies, so you need to ask them. We cannot approve, refuse or speed up a store refund, but we are happy to give you supporting information if it would help your request:

6. Refund Amounts and Taxes

Any approved restitution is strictly capped at the exact fiat amount remitted by the user at the point of sale. Promotional, early-access, or discounted pricing tiers establish the absolute maximum financial liability for any refund claim.

Refunds are processed in the original currency of the transaction. Where applicable, refunds will include the proportionate refund of any VAT, GST, or regional sales taxes collected at the time of the original transaction, remitted in accordance with the tax laws of the user's documented jurisdiction.

7. General Limitations and Subscription Administration

Cancelling your subscription: Cancellation of a subscription constitutes a revocation of future auto-renewal authorization; it does not constitute an early termination of the current, active billing cycle. You will retain uninterrupted access to ROXFIT Ultra features until the natural expiration of your current paid term. Except where section 4 or section 9 applies, or where your statutory rights require otherwise, ROXFIT will not issue pro-rata, fractional, or partial refunds for the unutilized duration of an active subscription tier.

For web purchases strictly within ROXFIT's administrative control, we reserve the right to issue discretionary refunds in exceptional, documented cases. We will review product-specific evidence provided by the user to determine eligibility. Such cases may include: (a) verifiable system-level technical failures or accessibility issues that entirely precluded access to the Services, (b) verified billing errors or proven duplicate charges, or (c) instances where the Services fundamentally failed to operate as advertised.

Subscription entitlements are technically isolated to the platform of origin. Subscriptions cannot be migrated, ported, or transferred between the Web checkout, Apple, and Google ecosystems. Users wishing to transition billing rails must allow their current subscription to lapse and subsequently re-subscribe via the desired platform. Upgrading or downgrading plans mid-cycle is managed entirely by the billing platform's inherent credit algorithms and sits outside the scope of this Refund Policy.

ROXFIT monitors refund frequency to prevent abuse of our Cancellation Period. We reserve the right to refuse future ROXFIT Ultra subscriptions or deny discretionary refunds to any user who exhibits a pattern of serial subscriptions and subsequent refund requests (for example, repeatedly subscribing and canceling within the 14-day window). This does not affect your free ROXFIT account or your statutory rights.

Uninstalling the ROXFIT application from your device or requesting account deletion pursuant to GDPR/UK GDPR does not automatically cancel your active premium subscription. You must proactively cancel your subscription via the applicable billing platform (Onelink for web purchases, the App Store, or Google Play) prior to account deletion to prevent future recurring charges.

ROXFIT may, from time to time, provision complimentary, promotional, ambassador, or research-based access to the premium Services outside standard commercial payment flows. Such entitlements possess zero intrinsic cash value, are strictly non-transferable, and establish no contractual right to monetary refunds, alternative compensation, or account credits under any circumstances.

In compliance with applicable consumer protection standards, ROXFIT ensures that cancelling your subscription is as straightforward as initiating it. You can terminate your auto-renewal at any time directly through your account settings on the applicable billing platform (Onelink account, Apple ID settings, or Google Play Subscriptions) without navigating through unnecessary retention flows, unjustified delays, or mandatory contact with customer support.

8. Payment Disputes and Chargebacks

Talk to us first. If you have a problem with a payment, please email [email protected] first. We can often sort it out quickly. This does not stop you from contacting your bank, your card provider, Apple, Google or Stripe's customer support at any time.

Web purchases. If you dispute a web payment with your bank or card provider (a Chargeback), Stripe, as merchant of record, handles the dispute. While a Chargeback is open, we may suspend your ROXFIT Ultra access. If the Chargeback is withdrawn or decided in favour of the seller, we will restore your access. If it is decided in your favour, your ROXFIT Ultra access will end, because the payment has been returned to you.

App Store and Google Play purchases. If you dispute a store purchase with Apple or Google and it is refunded, the store will tell us and your ROXFIT Ultra access will be removed.

Your free account. In every case, your free ROXFIT account and your data stay in place (see section 11). If we reasonably believe that a payment was fraudulent or that our refund process is being abused, we may suspend your ROXFIT Ultra access while we look into it.

9. Termination, Modification, and Force Majeure

In the event that ROXFIT restricts, suspends, or permanently terminates an account due to a violation of the ROXFIT Terms and Conditions (including but not limited to unauthorized account sharing, reverse engineering, or abusive behavior), the user unconditionally forfeits any eligibility for a discretionary refund. This does not affect your statutory rights, including any right to cancel during the Cancellation Period.

ROXFIT operates in a dynamic technological environment. We may change, suspend or discontinue features, content, integrations or ROXFIT Ultra itself for valid technical, security, legal, regulatory or commercial reasons, and we will give reasonable notice of significant changes. Small changes and improvements do not entitle you to a refund. If we make a change that materially reduces what ROXFIT Ultra offers, you may cancel and we will refund the part of the period you have paid for that remains unused. If we discontinue ROXFIT Ultra, or ROXFIT altogether, during a period you have already paid for, we will either continue to provide ROXFIT Ultra until the end of that period or refund you the part of it that you will not receive. For App Store and Google Play purchases, the refund is processed by the store under its own policies, and we will take the steps available to us to arrange it.

ROXFIT shall not be liable for any failure to provide the Services if such failure or delay is caused by a Force Majeure Event.

10. Data Privacy and Financial Record Retention

We keep records of purchases and refunds for the periods set out in our Privacy Policy, including where you ask us to delete your account. Our Privacy Policy explains how long we keep this information and why. Stripe, as merchant of record, also keeps its own records of web purchases under its own privacy policy.

11. Post-Refund Account Architecture

The execution of a refund acts as an immediate terminating event for premium entitlements.

The same applies if your ROXFIT Ultra access ends because you cancel and your paid period runs out, because it is suspended, or because a Chargeback is decided: you keep your free ROXFIT account and your data.

12. Miscellaneous and Final Provisions

If any provision of this Policy is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not impair or affect the validity, legality, or enforceability of the remaining provisions, which shall remain in full force and effect.

Consistent with our Terms and Conditions, this Policy, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales, subject to any overriding mandatory consumer protection regulations applicable in your country of habitual residence.

ROXFIT reserves the right to amend, update, or revise this Policy at any time to reflect changes in legal, regulatory, or operational requirements. Updated versions will be prominently published within the application and on our website. Continued use of the Services or failure to cancel an active subscription following such publication constitutes your acceptance of the revised Policy.
